Personal Injury:

Any time you are involved in a vehicle accident, slip and fall, or other type of bodily injury, you should always go to the emergency room to be examined, even if you feel that you have not been injured. Damage to muscles, tendons, ligaments and other strains not outwardly noticeable are often not felt until 24 to 48 hours after the accident. In addition, if you are physically able, always check your surroundings for cameras or possibly other people who may have witnessed what happened. Get identification and any other information if possible.

When considering divorce, first think about a consultation to explore any possible chance to repair the relationship. Many times a divorce can be accomplished in a relatively short amount of time with minimal expense if you and your spouse can reach an agreement on the terms before you call Chuck Davis Law. You might then be able to do what lawyers refer to as an uncontested divorce, which requires no court appearances and can save a great deal of time and money. Wills and Estates

Everyone needs to have a Last Will and Testament. It is essential that you make the decisions as to how your estate will be disbursed and divided and that can only be done with a valid Will. If you do not have a Will in the state of Alabama, the state has laws which will dictate how your estate is to be divided and who the beneficiaries will be. There could very well be someone in your family that you have never gotten along with and have no desire or reason to provide for them, but without a Will, they could be entitled to a portion of your estate according to the estate laws of Alabama. Additionally, you need to consider having a Healthcare Directive or Living Will, prepared in the event of a catastrophic medical event which leaves you unable to make your own medical decisions. Don’t leave those decisions to the doctors and the hospital, choose the person you want making those decisions. Also a Power of Attorney may be needed to allow a person you choose to make necessary decisions on your behalf which are not medically related.

Real Estate:

There can be many pitfalls in dealing with real esate issues. First, always remember that in Alabama any agreement pertaining to real property, or real estate, which the parties agree to must be in writing. Unlike other types of contracts, which may be deemed valid when only agreed to verbally, that does not apply to real estate contracts. Second, when buying a home in Alabama the thing to remember is “Buyer Beware”. There are no warranties that automatically go with a home that has been previously occupied. Buyers must be keeenly aware of potential problems or faults in a home and those concerns must be questioned and addressed specifically before making an offer to purchase. I always advise clients to hire a qualified home inspector to go through the property and do a thorough inspection and provide a written report of any current problems or potential problems that might become obvious after the sale. Also be aware of easements and right of ways that may impact your property.
